Okay, this is how I understood the licence and how it might actually turn out.
1. We are not allowed to sell addons, not even to companies which are allowed to use the tools commercially.
2. We are not allowed to use our addons commercially in any way so we can't give them away for free if they are going to be used commercially, even though the company has a licence to use the tools commercially.
If the second statement is false then we can still make money if an addon maker decides to give away the models for free and in the same time the company decides to pay you for the textures which aren't created with the aid of BIS tools.
The most likely scenario though is that the addon maker is honored that a company wants to use his addons so he gives them away for free. So instead of the company actually hiring the addon maker which appearantly is good enough for the company as they use his addons, he get exploited.
So I hope that an addon created under the licence agreement that comes with O2 light can't be used commercially in any way. As long as the addon maker haven't got access to a licenced version of O2 he can't create any commercial content. Incase he would get hired by a company with a licence he would get access to it, hence he would be able to allow the content created by him to be used commercially.

That would be a pretty odd claim to make. If I made a model, and imported it into O2 and used it as an OFP addon, I'd lose my right to sell it. That's not defensible. The license agreement could not be read that way.

What about Coalescent's exclusive rights to the North American market? Does this mean that BBN got around that by presenting BIS with a fait accompli, or am I reading this incorrectly? If so, any other company could potentially violate what I understood to be a binding agreement between BIS and Coalescent preventing any other company from licensing or pursuing a license to the engine in North America.Originally Posted by [b

I'm not sure what you're asking. a model in 3ds format can be imported into pretty much any game. It can be used in 2d or 3d advertisement, sold to the consumer market to private enthusiasts or people on contracts who need material to fill out work on short deadlines. check out for textures or model's prices.
You'll then probably see, why some addonmakers start
getting upset when use their work without permission.

the gaming world, as it's being used for advertisement,

models or textures, may have their own restriction (talking
about those being imported into o2 - especially models as textures is another story anyways) and whatever an EULA
for program A would say, if program B doesn't allow it's
result being used comercially, then the converting by program
A will not make it owned by program A at the end.
Same goes for free stuff taken from the web or elsewhere,
being restricted in their use - no license or whatever with
anybody else than the owner can change this restriction
and no other company will be able to say that this is now
their's because it has been used with their tools.
But they could disallow the use of their tools in combination
with whatever they want - e.g: you could then read in license that models from 'Electronic Farts' must not be imported - and maybe even a reason why (additional).
